Thank you for choosing Color Pulse! This agreement is a legal contract between you and us regarding the use of this game. Please read it carefully before using the game.
1. General Provisions
1.1 Acceptance of Agreement
This User Agreement ("Agreement") is jointly established by you ("User" or "You") and the developer of this game ("We," "Us," "Our," or "Developer") to govern your behavior in downloading, installing, using the Color Pulse game ("Game") and related services.
1.2 Effectiveness of Agreement
When you download, install, or launch the Game for the first time through an app store (including but not limited to platforms such as Apple App Store, Google Play, etc.), you are deemed to have fully read, understood, and agreed to be bound by all terms of this Agreement and the accompanying Privacy Policy.
1.3 Non-Acceptance
If you do not agree to any term of this Agreement, please immediately stop downloading, installing, and using the Game. If relevant platform rules or laws require you to confirm an updated version before continuing use, you must comply; otherwise, you may not be able to continue using the Game services.
1.4 Agreement Revisions
We reserve the right to revise this Agreement from time to time due to changes in laws and regulations or operational needs. The revised Agreement will become effective upon its publication within the Game or on the official website. We recommend that you periodically review it to stay informed of the latest content.
1.5 Service Adjustments
We reserve the right to adjust, suspend, or terminate part or all of the Game services at any time based on operational needs, including deciding to suspend or limit your access to and use of the Game, without further individual notice.
2. Service Usage Guidelines
2.1 Fee Responsibility
You are solely responsible for any network communication fees, data charges, and related equipment costs incurred while using the Game services.
2.2 Age Restrictions
You confirm that you are at least 13 years old when you start using the Service.
If you are between the ages of 13 and 18, please read this Agreement with your legal guardian (e.g., a parent) and ensure your guardian understands and agrees to all terms of this Agreement before using the Service.
2.3 Assumption of Risk
You understand and agree that downloading, installing, and using the Game services is at your own risk. The Game services are provided on an "AS IS" basis, and we assume no responsibility for incompatibility with your device, operating system, or network environment.
3. Accounts and Data Management
3.1 No-Account Mode
To protect your privacy, this Game is designed to be playable without registering an account.
3.2 Local Data Storage
Your game progress is primarily saved in your device's local storage. If you uninstall the Game, clear the application cache, or change devices, you may lose your game progress. To the maximum extent permitted by law, we are not liable for such losses.
3.3 iCloud Backup (iOS Devices Only)
For iOS devices, you may choose to use Apple's iCloud service to back up your game progress. Please note that this feature is operated independently by Apple Inc., and the management and use of your data are subject to Apple's iCloud terms of service and privacy policy, and are not our responsibility.
4. Fees and Purchase Terms
4.1 Acquisition of Virtual Currency
Virtual currency (e.g., coins, diamonds) and other virtual items within the Game should only be obtained through officially recognized channels. We reserve the right, without prior notice, to delete, reclaim, or invalidate virtual items obtained through unofficial, illegal, or improper means (e.g., exploiting system vulnerabilities, using cheats).
4.2 Nature of Virtual Items
All virtual currency and items are limited to use within the Game, have no legal currency attributes, cannot be exchanged for physical goods or real currency, and cannot be transferred or traded outside the Game in any form.
4.3 Policy Adjustments
We reserve the right to adjust the types, pricing, acquisition methods, or functions of virtual currency and items after providing reasonable notice.
5. User Conduct Guidelines
5.1 Legality and Compliance
All your actions and content generated while using the Service must comply with all applicable international, national, and local laws and regulations and must not infringe upon the legal rights of any third party (including but not limited to other users, rights holders).
5.2 Prohibited Actions
You agree not to engage in any actions that undermine game fairness, interfere with the normal operation of the Game, or infringe upon others' rights while using the Game, including but not limited to:
Using Cheating Programs: Using cheats, bots, accelerators, or other third-party cheating software.
Exploiting Vulnerabilities: Intentionally exploiting system vulnerabilities, errors, or design flaws in the Game for personal or others' gain.
Interfering with Services: Engaging in any actions intended to interfere with, disrupt, or limit the normal operation of the Game services.
Infringement: Infringing upon our intellectual property rights or those of any third party, trade secrets, or other rights.
5.3 Handling Violations
If we have reason to believe you have violated the above code of conduct, we have the right, without prior notice, to take appropriate measures based on the severity of the violation, including but not limited to: warnings, temporary feature restrictions, permanent ban from using the Game services, etc.
6. Intellectual Property
6.1 Ownership
All intellectual property rights contained in this Game (including but not limited to its source code, object code, art design, music, text, characters, interface layout, and related documentation) are owned by the Developer and its licensors. Unless expressly provided otherwise by laws and regulations, no entity or individual may use them in any way (including but not limited to copying, distributing, modifying, decompiling, reverse engineering) without our prior written permission.
7. Disclaimer
7.1 Service "AS IS"
The Game services are provided on an "AS IS" and "AS AVAILABLE" basis, to the maximum extent permitted by law. We make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-interference, and freedom from errors.
7.2 Exemption from Liability
We shall not be liable for any losses caused by force majeure events (e.g., natural disasters, wars, governmental actions), third-party service issues (e.g., network outages, device failures), or your own improper use (e.g., failure to comply with this Agreement).
8. Limitation of Liability
8.1 Cap on Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, punitive, or special damages (including but not limited to loss of profits, data loss, or business interruption) arising out of or in connection with the use or inability to use the Service, even if we have been advised of the possibility of such damages.
9. Governing Law
9.1 Applicable Law
The formation, validity, interpretation, performance, and resolution of disputes arising from this Agreement shall be governed by the laws of the People's Republic of China.
10. Severability
10.1 Severability
If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction or competent authority, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement shall remain in full force and effect.
11. Assignment
11.1 Assignment of Rights and Obligations
We have the right to assign all or part of our rights and obligations under this Agreement to our affiliates or any subsequent acquirer or successor without obtaining your further consent. You may not assign any of your rights or obligations under this Agreement without our written consent.
